For purpose of this agreement, Service Provider will mean (PetersPTE)
And User will mean, the person (legal or biological) who has registered a User ID with the Service Provider thorough this site (www.wordpress-1214304-4310461.cloudwaysapps.com) and who is going to make payment to the Service Provider for the services rendered by this web site.
For purpose of this agreement
1. For Users as defined hereinabove, through this website, Service Provider will provide tests (Reading, writing, listening, and speaking) which are similar to and created based upon ‘Pearson Test of English’ method.
2. Through this web site, Users will be able to take tests (Reading, writing, listening, and speaking) which are similar to and created based upon Pearson Test of English (PTE). The test result will be rendered by AI (Artificial Intelligence)
Only Users will be entitled to take tests by this website. Users are strictly prohibited to allow any other person to take tests who are not registered users of this website.
It is understood by the User that natural and legal users may obtain different privileges and service charges from the Service Provider and the User have no objection to that.
Service Provider shall retain all right, title and interest in its patents, copyrights, trademarks, proprietary and/or licensed software, service marks and trade secrets (“Intellectual Property Rights”). No interest whatsoever in the Service Provider’s Intellectual Property Rights is granted by this Agreement
The User shall not license, sell, publish, disclose, display or otherwise make available the Intellectual Property Products of the Service Provider to any person or entity except as provided in this Agreement. Service Provider may include security modules in its Intellectual Property Products to protect its rights to the fullest extent permissible by applicable law or regulations, the Use agrees that it will not, nor will it allow others to, reverse engineer or disassemble any parts of the Service Provider’s Intellectual Property Products. User shall not use the Intellectual Property of the Service Provider in any manner whatsoever without the prior written consent of the Service Provider.
The Users will have the right to use facilities provided by this website in a manner and at times as may be determined by the Service Provider from time to time.
All data collected from the User will be kept confidential and will not be shared by the Service Provider without express permission of the User. The Service provider will have the right to check and assess the data received from the Users to contemplate to improve its services & marketing uses. However, if any competent authority, authorized by the laws of Bangladesh demands such data from the Service Provider, Service Provider may transfer the data without informing the User.
a) User has already check various packages rendered by the Service Provider and will pay according to his preferred package.
b) By making additional payment, User can always upgrade his package, however, once upgraded, User cannot downgrade it within the timeline of the package.

a) Service Provider will try its best to keep the site up and smooth running.
b) User will not do anything which impairs the service of the Service Provider, nor he will share his user ID and password to any third party.
All information provided and regarding the Service Provider will be deemed confidential and cannot be disbursed by the User to anyone without written permission from the Service Provider. However, the following information will not be considered as confidential.
1. If the information is already in public domain.
2. Need to be disbursed to effectively obtain service from the Service Provider.
3. The User received the information from an independent third party.
Without sowing any reason whatsoever, by serving an e mail, Service Provider may terminate this agreement. In such case the return policy as above detailed will be applicable.
Although the Service Provider has created this website having improvements of the Users in mind, Service Provider does not warrant satisfaction of Users or improvement of its Users in any aspect and does not warrant that using this website will be beneficial to the users in any sense.
User agrees to indemnify, defend and hold harmless the Service Provider, its Onwer, affiliates, officers, representatives, employees and agents (collectively, the “Indemnified Persons”), from and against any and all claims, actions, suits, proceedings, costs, damages, judgments, amounts paid in settlement and expenses (including without limitation reasonable attorneys’ fees and reasonable disbursements at actual) (collectively, “Loss”) asserted against or incurred by the Service Provider, to the extent directly suffered (excluding consequential or special losses), as a result of, arising from, or in connection with or relating to any matter inconsistent with, or any breach or inaccuracy of any representation, warranty, covenant or agreement made or failure to perform (whether in whole or part) any obligation required to be performed by the User under this Agreement or non-observance / noncompliance of any applicable laws, rules and regulations
Service Provider do possess exclusive right to change or upgrade content of this website without making any prior notification to anyone.
The Service Provider will not be held responsible or liable if it fails to provide its service due to situations which can be considered as Act of God or upon situation on which the Service Provider has no control or due to situation which is beyond service providers control.
Governing Law of this agreement will be Bangladeshi law in force
Any and all claim and dispute between the Service Provider and the Users will be settled by applicable Arbitration law of Bangladesh only.
